The Minister shall, within 9 months of the passing of this Act, bring a report on the feasibility to provide for the establishment of a regulator for the Marine Casualty Investigation Board. The regulator will, if deemed agreeable by the Minister be responsible for ensuring that appointments to the Marine Casualty Investigation Board are appropriate, fair and that there is no conflict of interest. The new appointee will take into consideration the recommendations of the Lacey Report, the Clinch Report, the ruling of the European Court of Human Rights and the pre-legislative scrutiny report from the Joint Committee on Transport and Communications on the Merchant Shipping (Investigation of Marine Casualties) (Amendment) Act 2022 , and any other relevant information/submissions the Minister deems appropriate.
