The key question at the moment concerns linking Part 5 protections to the emergency and the additional protections that are afforded. We must strike a fine balance to introduce a measure that will be constitutional and will work. The Department has assessed this in detail and it is our considered view that as we move through the stages of reopening the economy, protections must be linked to the paying of rent in the normal manner. If a tenant is under pressure or is unable to pay due to the emergency, this Bill will provide the protocols enabling him or her to seek protection.
