Criminal Justice (Mutual Recognition of Custodial Sentences) Bill 2021: Report and Final Stages Dail Éireann — 2023-02-08 ============================================================ James Browne (FF), Wexford I move amendment No. 50: In page 38, line 18, to delete "in the State". Amendments Nos. 50, 51 and 54 to 57, inclusive, are grouped. They deal with situations where enforcement either ceases absolutely or reverts to the issuing state. Amendment No. 50 clarifies that enforcement reverts to the issuing state if the person escapes and is not retaken, regardless of whether the escape takes place in the State or otherwise. Amendment No. 51 clarifies that the cessation of enforcement in question is that of the State rather than the issuing state, while amendments Nos. 54 to 57, inclusive, clarify the process by which a person may be released should the issuing state notify this State that enforcement of the sentence should cease. --- Source: Houses of the Oireachtas.
