International Protection Bill 2026: Committee Stage Dail Éireann — 2026-02-18 ============================================================ Jim O'Callaghan (FF), Dublin Bay South I move amendment No. 5: In page 16, between lines 34 and 35, to insert the following: " "absconding" means the action by which an applicant does not remain available to the competent administrative or judicial authorities of a Member State, such as by leaving the territory of the state without permission from the competent authorities, for reasons which are not beyond the applicant’s control;". This amendment is being introduced to provide clarity on the application of several sections of the Bill. It provides a definition of "absconding". The wording provides for the definition in the reception conditions directive. This directive is not directly applicable and, therefore, it is necessary to transpose its provisions into national law. Provisions in the Bill, in the directly applicable asylum and migration management regulation and in the asylum procedure regulation concern absconding. It is, therefore, necessary to clearly define what we mean by "absconding" for the purposes of the Bill. --- Source: Houses of the Oireachtas.
