Article 8.39(3) states, "For the calculation of monetary damages, the Tribunal shall ... reduce the damages to take into account ... repeal or modification of the measure." If you change or repeal the law, you will have less of a bill. If that is not a clear chilling effect, I do not know what is. The Minister of State also did not address "fair and equitable".
