Payment of Wages (Amendment) (Tips and Gratuities) Bill 2022: Committee and Remaining Stages Seanad Éireann — 2022-06-29 ============================================================ Mary Seery Kearney (FG), Nominated by the Taoiseach It is unenforceable but it is possibly indefensible also. How does one prove that something happened or did not happen when it comes to cash? One could potentially leave an employer open to false allegations that he or she could not defend whereas at least in other provisions in employment law the onus is on the employer to prove it. They would not be able to prove that tips came or did not come. I can see how it would be unenforceable. --- Source: Houses of the Oireachtas.
