That is why some of the explanations to the amendments can sometimes be a bit convoluted because it is a difficult area of law. As the Minister of State pointed out, it is trying to ensure that we transpose into law the full effects of an EU directive and that we get it right. In this instance, I do not think we have got it right. We did not get it right in the past. That is why we are at this stage. We are addressing failures in the past. We may be back here again. While I firmly believe the intention is correct, the full effect of it will not be. I am still gobsmacked at the referral of anybody to court when there is an alternative mechanism available, which does not fall foul of the EU directives. --- Source: Houses of the Oireachtas.
