On prevailing side: this member voted with the winning side in 29 of 239 decisive votes (0 abstentions excluded). Read it as a government-or-opposition indicator rather than a measure of influence — the figure is near 100% for members supporting the government of the day and near 0% for those opposing it.

Party over time

This is the point of the site: contributions keep the party held on the day, not the one held now.

Judicial Appointments Commission Bill 2022: Committee Stage (Resumed)

On the citizenship point, I may put down an amendment on Report Stage to remedy what is clearly a lacuna in our system. One has to be a citizen of Ireland to be a Member of this House and the Dáil and for many other purposes. It is strange that one can interpret the Constitution while not owing the duty cast on citizens by the Constitution, I think in Article 8 or Article 9, of a fundamental duty of fidelity to the nation and loyalty to the State. I think it is strange that we allow non-citizens to become members o…

Judicial Appointments Commission Bill 2022: Committee Stage (Resumed)

That is the baleful eye of the Department of Public Expenditure, National Development Plan Delivery and Reform. It has very little to do with the Department of Justice as I knew it.

There was an amendment in my name. Has it been ruled out of order?

Curious. Can I just say what it was about?

The point I am making is very simply this-----

IND 2023-03-07 · Seanad
Judicial Appointments Commission Bill 2022: Committee Stage (Resumed)

We are amending the Judicial Council Act. There is a clear typo in that Act, which the amendment I tabled was designed to deal with. At present, subsection 50(4) of the Judicial Council Act 2019 states: "A complaint may be made under subsection (1) on behalf of ... a member of the [Bar] Council ... by a duly authorised officer of the General Council of the Bar". That was just a mistake; it was meant to state "barrister" and not just "member of the Bar Council", which would be about 20 people. I raised the matter in…

-----and therefore become law once proceedings in this House were completed. Now there is a clear opportunity to take out the mistaken words and substitute the correct ones. There is every reason, given we are amending the Judicial Council Act, to correct a clear mistake of that kind. That is as far as I will put it.

By the way, there is a method to do it, even if it is outside the scope of the Bill and I have to defer to the ruling of the Acting Chair. That correction to the Judicial Council Act can be dealt with under the rules of this House. If there is a will to do it, it can be done.

Judicial Appointments Commission Bill 2022: Committee Stage (Resumed)

I will say a few things about the Schedule. I will not detain the House long. The Schedule deals with the constitution of the commission and sundry provisions relating to its procedures and staff. I will take the opportunity to reiterate that the Constitution adopted in 1937 accorded to the Government of Ireland, a democratically elected body, the right to choose from eligible people who should be judges. That is a cornerstone of our Constitution. Other people do not like it and have said from time to time that the…

An tOrd Gnó - Order of Business

I welcome unreservedly the progress made on the Windsor Framework. At the Committee on European Union Affairs today, interesting testimony was received from the Irish Road Haulage Association on the possible unintended side effects of the new agreement for the Irish road haulage industry and the unresolved issues in respect of Irish road haulage export and import of European products, which effectively has been on hold throughout the Brexit crisis and the crisis that has followed in British politics since then. I a…

Citizens Assembly on Drugs Use: Motion

I second the amendment in the name of Senator Boyhan. I want to say a couple of things about the general concept of a citizens' assembly. The issues here are not unique to Ireland and are not misunderstood. There are fundamental issues of policy to be addressed. For instance, the state of California has legalised the use of cannabis. A lot of people take the view that it is pointless to suppress the use of cannabis by the use of the criminal law. It is suggested that it simply creates revenue streams for organised …

An tOrd Gnó - Order of Business

I welcome H.E. Marijus Gudynas, the Lithuanian ambassador, and Deputy Devlin. I salute the people of Lithuania on their national day. I want to raise today an issue that deserves consideration by this House in a calm, reflective way. The issue concerns gender dysphoria, the treatment of prepubertal, peripubertal and postpubertal children, the services that are, or are not, available in Ireland, and what appears to be a dispute between different factions, if I may use that phrase, over how this issue should be dealt…

Central Bank (Individual Accountability Framework) Bill 2022: Committee Stage

I move amendment No. 1: In page 8, between lines 14 and 15, to insert the following: “PART 2 GENERAL DUTIES OF THE BANK General duty of the Central Bank to make disclosure 3. (1) In conducting any proceedings or investigation in respect of any natural person (including any appeal or application to the High Court) where that person may become liable to any prohibition or penalty under the provisions of the Act of 1942, the Act of 2010 or the Act of 2013, the Central Bank shall be subject to a duty of full disclosure…

Fair enough. I am grateful to the Minister of State for her remarks. There are a few issues which arise from them. First, in relation to amendment No. 1, does the Minister of State accept that there is such a duty of disclosure?

Yes, we can do a question-and-answer here. On amendment No. 1, Does the Minister of State accept there is a duty of full disclosure on the bank?
