Amendment No. 16 is a technical amendment that repeals section 20 of the International Protection Act 2015 which provides for the detention of applicants in certain limited circumstances. Where an applicant is detained under amendment No. 109, amendment No. 111 provides for the rights of the applicant and ensures they are able to avail of effective legal protections under this Bill, including access to legal assistance and legal representation.
In the interests of protecting minors during the international protection process, amendment No. 113 provides for the Child and Family Agency to be notified where an applicant is detained under amendment No. 108, and the minor is in the custody of the detained applicant.
